HSSB to take next step in legal process on Guiness Rd. property

CROSSVILLE — The Health and Safety Standards Board decided to take further action after no response has been made after a letter of violation was sent to the property owner of 93 Fox Den Lane.

The letter was sent last month and county attorney Randal Boston's office reported there has been no response to the letter.

HSSB member Nick Hedgecoth moved to go to the next step in the violation process, which is sending a letter of action. The letter states if no action is taken to clean the property legal action will continue. The motion was supported by Darrel Comer and unanimously approved.

In other areas, the board received an update from county attorney Boston's office regarding property at 145 Guiness Rd. A letter has been drafted and will be sent to Bank of America, giving them 30 days to respond, cleaning up the property or further legal action will be taken. If no action is taken, the county could file suit against Bank of America.

So far, no action has been taken toward cleanup, other than the lawn has been mowed on occasion. In the past, neighbors have complained about the odor, rat infestation and snakes at the property.

Nancy Hyder, 2nd District commissioner and HSSB chairman, reported she drove past property at 467 Carter Town Rd. and it has been totally cleaned up.

A new complaint was submitted about a property at 404 Bent Tree Dr., but the board decided not to take any action because it was determined to be a trailer.

Randy Elmore made a motion not to take action and the motion was supported by Hedgcoth and unanimously approved.

In order to come under action from the county by the HSSB, the property must be a dilapidated, abandoned home that is fixed to a foundation, or in the case of manufactured homes, has had the title surrendered to the state and an affidavit of affixation has been filed with the Register of Deeds office.

The HSSB set its next meeting for Nov. 12 at 3 p.m. in the conference room on the second floor of the Cumberland County Courthouse. The public is welcome to attend.
