Architectural Control non-compliance fees implemented

CROSSVILLE — To improve compliance with the ACC Rules; expectations of our members, it has become necessary to establish incentives for compliance. The ACC Committee proposed non-compliance fees, and the Board of Directors has approved them.

The ACC Committee and the Board of Directors do not seek punishment, but do seek compliance.

The Architectural Control Committee was created by the various Covenants in our community, and the by-Laws of Lake Tansi Property Owners’ Association, Inc. Section 11.09 Architectural Control Committee:

(d) The Architectural Control Committee shall be responsible for the enforcement of the policies and procedures adopted by the Board of Directors; and shall regularly report to the Board of Directors with respect thereto.

The primary complaints being received by the P.O.A. were related to buildings, landscape maintenance and parking. The ACC rules for these issues are clarified herein.

Section 7

Buildings –

Clarification

The number of buildings on any lot shall not exceed two unless the garage is detached creating a third.

The residence (house), as specified elsewhere, is required before other buildings are permitted.

An outbuilding to be used for storage or as a workshop is considered to be the second building. A shed sitting on skids is considered to be an outbuilding.

A detached garage is considered a third building and allowed if there is no attached garage. The normal detached garage is sized as 24’ deep x 24’ wide and 14’ high. This includes an appropriately pitched roof.

A carport without sides could be considered in absence of a garage.

Sidewalls are not allowed on a carport. All carports must be anchored to a concrete foundation and have a concrete slab floor.

The following building combinations are allowable with appropriate ACC permits:

• House with attached garage, outbuilding or shed. (2 buildings)

• House without attached garage, detached garage or carport, outbuilding or shed (3 buildings)

A separate permit, issued by the ACC, is required for each building. Violation is subject to compliance fees.

Section 9

Landscaping –

Clarification

Homeowners are responsible for maintaining all property in a visually acceptable manor.

A cleared lot and all lawns must be maintained regularly – mowing, weed control in flowerbeds, etc. Lots should be maintained frequently enough to avoid becoming irritants to the community or become overgrown with brush etc. The lawn standard is a lawn grass height of six inches – it needs cutting.

A lawn exceeding eight inches in height (free standing) is in violation of the standard and subject to compliance fees. 

Flower beds, should be maintained at least monthly or become subject to non-compliance fees.

Lawns should not become visually cluttered with building materials, shipping materials, toys, trash, garbage, firewood, etc. A small homeowners neat stack of building materials or firewood is allowable. Covered trash/garbage containers should be stored out of sight as possible and not in the front yard.

Violation of this visual clutter provision is in violation of the standard and subject to non-compliance fees.

Section 12

Vehicle storage – Clarification

Unlicensed and/or non-operative vehicles may not be stored or parked on any lot. Those vehicles parked inside a garage are considered exempt. Non-operative vehicles awaiting repair must not be stored outside on a lot for more than an accumulated total of 14 days.

Any vehicle in an inoperable condition found to be left on a lot more than 14 days is subject to compliance fees.

Non-compliance Fee Structure

Permit violation $200

If a structure is started prior to ACC approval of a permit, the doubling of normal fee doubling plus the non-compliance fee will apply. This fee can be waived if permit request is promptly submitted once identified. This is at the discretion of the General Manager.

Lawn maintenance

violation $50

This fee can be applied up to 12 times during any year on a two-week interval if the problem issue isn’t corrected.

A letter issuing the non-compliance fee will be sent each time it is applied and the three step process is not required although a site visit is required to document continued non-compliance.

Vehicle storage

violation $ 50

This fee can be applied up to 12 times during any year on a two week interval if the problem issue is not corrected.

Repeat violations $200

This additional non-compliance fee will be assessed, if a repeat of a non-compliance issue occurs within 18 months of a previously issued non-compliance fee on the same issue. 

A set of administration guidelines has been provided to the GM’s office to insure the fair usage of these non-compliance incentives.

    A lot of people have visited Cumberland County, liked what they saw and eventually bought a house. Can Betty Gates be included in that group? Well, yes and no.  She came to Cumberland County to visit her brother who had retired from the United States Air Force. He took her on a tour of the area, including a drive through Tansi on Dunbar Rd. One of his neighbors, a real estate agent, also took her on a tour where he showed her a number of houses, one of which she bought. It was just two days after she arrived at her brother’s house. Here’s how she described the moment: “I have landed on my mountain.”  That was near the end of 2008.

    Joann Kelso’s nursing career began when she went to nursing school on a grant in Cleveland, Ohio. The grant allowed her to acquire her degree but, in return, she was obligated to work in Cleveland for two years. By this time her friends were settling down, getting married, and having babies. Kelso decided that wasn’t what she wanted at that time and enlisted in the Navy.

    The Quack Shack is looking forward to the second summer at the Lake Tansi Beach, keeping the same great menu, and continuing the Thursday night Dinner on the Deck with live music and great new foods. This summer, the Quack Shack will still offer our stress free party packages. The beach activities have been expanded with more bonfires and movies nights. Please come out and enjoy all the actives planned for this summer.

  • Ladies Golf kicks off season with luncheon

    The Lake Tansi Ladies Golf Association will be holding their spring luncheon at Killeen's on the Green on Thursday, April 3. Registration begins at 11 a.m. and lunch will be served at noon. Killeen's needs a head count, so please sign up in the ladies locker room at the Pro Shop before March 26.
